Energy services companies (ESCOs) may only enroll new or renew existing residential or small non-residential customers if they meet at least one of three conditions: guarantee savings over utility prices, offer fixed-rate products priced no more than 5% above the trailing twelve-month average utility rate, or provide renewable energy products with at least 50% greater renewable mix than required standards.

ESCOs must guarantee savings to all low-income customers and submit documentation to the Department of Public Service prior to enrollment, including calculations showing the customer will pay no more than the default utility rate.

ESCOs must obtain affirmative consent from customers before enrolling them in contracts that provide renewable energy without guaranteeing savings.

ESCOs must provide publicly available transparency and disclosure statements on their websites showing price per kilowatt-hour comparisons with utility rates and renewable energy content percentages.

ESCO disclosure statements must be posted on the Public Service Commission's website, and enrollment contracts must include 14-point font notices disclosing customer cost comparisons with default utility rates; the bill takes effect immediately.
