Amends the Emergency Tenant Protection Act of 1974 to modify how legal regulated base date rent is determined in rent overcharge cases.

Establishes that when an overcharge is found, the legal regulated base date rent at the four-year lookback shall be determined by either the survey sampling method or the default method if there is fraud.

Applies to housing accommodations in cities with populations under one million or towns and villages where an emergency has been declared.

Maintains existing provisions allowing the Division of Housing and Community Renewal or courts to consider all available rent history reasonably necessary to determine overcharges and legal regulated rent.

Takes effect immediately upon enactment.
