Expands the definition of assault in the second degree (Penal Law § 120.05) to include assault against additional transit workers: station customer assistants, fare payment personnel, and maintenance/repair workers for transit signal systems, tracks, stations, and train yards.

Adds new subdivision 3-a to Penal Law § 240.30 establishing harassment in the second degree charges for striking, shoving, kicking, or spitting on on-duty transit employees including train operators, bus operators, station agents, cleaners, and supervisors of such personnel.

Applies protections to employees of any transit or commuter rail agency, authority, or company (public or private) authorized by New York state or its political subdivisions.

Specifies that assaults and harassment charges apply when employees are performing assigned duties related to train or bus operation, including cleaning, fare collection, maintenance, and customer assistance.

Takes effect on the ninetieth day after becoming law.
