Amends Education Law sections 4003 and 4405 to establish annual growth rates for tuition and fees charged by approved special education providers, effective for the 2023-2024 school year and thereafter.

Growth rates for special education programs serving school-age and preschool students shall increase by the greater of: (i) the year-over-year percentage increase in statewide general support apportionments for public schools, or (ii) zero percent.

Applies to tuition and fee-for-service rates for private residential/nonresidential schools for students with disabilities, special act school districts, July and August disability programs, and preschool disability services including special classes, evaluations, itinerant services, and transportation.

Removes outdated 1995-1996 school year tuition adjustment language from existing law.

Takes effect immediately upon enactment.
