Removes the "not" from Section 58 of the Highway Law to make the state liable for damages from defects in state highways maintained by the state.

Eliminates the seasonal limitation that previously restricted state liability to only May 1 through November 15.

Establishes that state liability applies only when the state has received actual or constructive notice of the highway defects.

Clarifies that the state remains not liable for defects in bridges over which it has no control.

Takes effect immediately and applies to any cause of action accruing on or after the effective date.
