Commissioner of Housing and Community Renewal must promulgate rules authorizing voluntary use of electronic records and signatures for residential leases subject to annual registration requirements.

Rules must include procedures regarding notification to tenants about affirmative consent to electronic records, consistent with state technology law requirements.

Division must develop consent forms in the six most commonly spoken languages other than English (per U.S. Census data) clearly stating electronic records use is voluntary and cannot be required by landlords.

Electronic records cannot be accepted by courts or the division unless a signed consent form is provided to those entities.

Bill takes effect on the same date as chapter laws of 2021 relating to electronic records and signatures for residential leases (bills S. 4742 and A. 2679).
