Division of Criminal Justice Services shall develop and implement a statewide electronic tracking system for sexual assault evidence collection kits in consultation with the Department of Health, Office of Victim Services, Division of State Police, and New York State Coalition Against Sexual Assault.

The tracking system must monitor evidence collection kits through the entire criminal justice process, from initial collection at healthcare facilities through law enforcement storage and crime laboratory analysis to final destruction.

Healthcare facilities, law enforcement agencies, crime laboratories, and prosecutors must be able to update and track kit status and location; survivors may anonymously track their own kits.

All medical providers, law enforcement agencies, forensic laboratories, and other entities with custody of sexual assault evidence collection kits must participate in the system by January 1, 2024.

Tracking system records are confidential and may be accessed only by the survivor or employees of participating entities for updating and tracking purposes.
