S. 8171 - Carbon Dioxide Removal Leadership Act

• Establishes a reverse auction mechanism beginning in 2025 for New York State to purchase carbon dioxide removal (CDR) services annually from April 1 to June 30, with a target of removing 15% of statewide 1990 greenhouse gas emissions by 2050.

• Sets maximum price per ton at $350 in 2025, decreasing 5% annually with inflation adjustment, starting with minimum annual removal target of 0.1 megatons and scaling up to meet net-zero goals through specified percentage increases through 2050.

• Requires bidders to provide life-cycle analysis, measurement/reporting/verification, and documentation of CDR durability for at least 100 years, with approved methods including terrestrial mineralization, biochar, marine-based capture, construction materials, and direct air capture with geologic sequestration.

• Prioritizes bid selection through scorecard criteria including price, in-state location, scalability, delivery timeline, state tax liability, ecological benefits, and benefits to disadvantaged communities with job creation potential.

• Funds the initial five-year program (2025-2029) through reinstated state tax revenues on aviation gasoline imported or produced by petroleum businesses; repeals existing carbon dioxide emissions tax provisions.
