Adds new section 16.38 to the Mental Hygiene Law prohibiting the state from withholding funding to service providers for people with developmental disabilities based on receipt of COVID-19 federal funds.

Applies to organizations holding operating certificates, organizations requiring commissioner approval, and programs funded or administered by the Office for People with Developmental Disabilities.

Protects federal funds received through Paycheck Protection Program loan forgiveness, Federal Emergency Management Agency emergency protective measures, CARES Act of 2020, Families First Coronavirus Response Act, and American Rescue Plan Act of 2021.

Includes protection for other extraordinary federal pandemic relief funding.

Takes effect immediately and is deemed effective retroactively to March 13, 2020.
