Department of Health shall charge ambulance services a uniform assessment fee of at least 5.75% of annual revenue, not to exceed the maximum allowed under federal regulations (42 C.F.R. 433.68(f))

Fee exemptions apply to municipal fire departments, police departments, other government entities providing emergency medical services, aircraft-exclusive emergency medical providers, and providers already paying assessments under Article 28 of Public Health Law

All collected fees must be expended timely solely to increase Medicaid payment rates for ambulance services and cannot reduce or replace other state payment commitments

Department shall establish and maintain a dedicated fund containing fee revenues, federal matching funds generated from increased payment rates, and interest earned on fund balances

Fees shall only be collected if federal financial participation is available, with the department required to submit necessary documentation and amendments to the state Medicaid plan for federal approval
