Energy brokers and energy consultants must register with the Public Service Commission before operating in New York; violators face penalties up to $5,000 per violation.

Registered energy brokers must demonstrate financial accountability with a bond or equivalent of at least $100,000; energy consultants must provide at least $50,000.

Energy brokers and consultants must disclose the form and amount of compensation to customers on contracts, and if an ESCO collects compensation on their behalf, it must be added to the customer disclosure label.

Rebates and kickbacks to customers or their representatives are prohibited; violators face penalties equal to the greater of $5,000 or ten times the compensation or rebate amount.

Annual registration fee of $500 required for each registered energy broker and consultant; act takes effect 180 days after enactment.
