Employees and independent contractors must notify their employer or contractor within three hours of receiving a positive COVID-19 test result.

If the employer's or contractor's place of business is closed, notification must be provided by 10:00 a.m. on the next business day or three hours after the business opens, whichever is later.

Violations are classified as a misdemeanor and/or subject to a civil fine of $1,000 per day or part thereof that notification is not given.

All collected fines are deposited into the disease management account established by the state comptroller in the special revenue-other fund.

The notification requirement does not apply to persons incapable of providing the required notification.
