Each state agency must establish a teleworking policy and program allowing employees to perform all or part of their duties remotely to the maximum extent possible without reducing employee performance.

State agencies must designate a "telework coordinator" responsible for overseeing implementation of teleworking programs.

"Telework" is defined as performing normal work functions on a workday at a location other than the agency's principal location, eliminating or substantially reducing commuting.

Agencies cannot establish teleworking policies for employees covered by collective bargaining agreements unless the policy is mutually agreed to between the agency and the recognized employee organization.

The act takes effect 90 days after becoming law.
