New curricula or programs offered by accredited not-for-profit colleges or universities that have operated continuously in New York for 10 years are automatically registered 45 days after submission of a complete application, unless the department identifies deficiencies within that period.

Institutions meeting the criteria may offer previously approved programs in distance learning format by notifying the department 30 days in advance, without requiring re-approval.

Colleges must notify the regents within 30 days of being placed on probation or losing accreditation by their institutional accrediting agency.

Institutions on probation or with terminated accreditation remain subject to commissioner program approval until removed from probation status and must maintain that status for at least 6 years before automatic registration applies.

The commissioner must establish and maintain a public database tracking the status of submitted curriculum requests, including receipt dates, initial reviews, departmental questions, and final approval decisions.
