Commissioners of elections are appointed by county legislative bodies or, in New York City, by the city council.

If a legislative body fails to appoint a party-recommended candidate within 30 days, party members in that body may appoint the person, or the person is deemed appointed after 30 days if no party members exist in the body.

If party members exist in the legislative body and take no action within 60 days of filing a certificate of recommendation, the recommended person is deemed appointed automatically.

Party members may reject a recommended person by majority vote and file a new certificate within 30 days recommending a different candidate; if the new candidate is not appointed within 30 days, they are deemed appointed.

If a party fails to file a certificate within prescribed timeframes, party members in the legislative body may appoint any eligible person to the commissioner position.
