Health maintenance organizations must offer out-of-network coverage as an optional rider to any contract and provide at least one contract option that includes out-of-network coverage.

Insurers subject to Article 49 of the Insurance Law must offer out-of-network coverage as an optional rider to any policy and provide at least one policy option that includes out-of-network coverage.

Health service corporations must offer out-of-network coverage as an optional rider to any contract and provide at least one contract option that includes out-of-network coverage.

All out-of-network coverage options must be made available both within the statewide health benefit exchange and outside of it.

The act takes effect on January 1 of the year following enactment and applies to contracts and policies issued, renewed, modified, or amended on or after that date.
