Deputy sheriffs who provided police protection or correction officer service may transfer service credit from the New York State and Local Employees' Retirement System (NYSLERS) to the New York State and Local Police and Fire Retirement System (NYSLPFRS) if they elect to do so within one year of first joining NYSLPFRS or within one year of this law's effective date.

Service credit transferred to NYSLPFRS is calculated by multiplying the eligible service by a salary multiplier and billing rate multiplier determined by actuaries of both retirement systems, and cannot exceed the original service credited in NYSLERS.

If a member subsequently transfers back to NYSLERS, the full amount of service credit earned as a deputy sheriff is transferred back to that system.

Members who retire on an age-based retirement plan in NYSLPFRS instead of a twenty or twenty-five year plan receive the full amount of service credit earned as a deputy sheriff.

No member receiving service credit under this provision is eligible to receive additional service credit under existing provisions if their employer has already elected to provide such credit.
