Creates a rebuttable presumption that heart disease causing total or partial disability or death in deputy sheriffs employed in cities with populations of one million or more was incurred in the performance of duty, provided the employee passed a physical examination upon entry that revealed no evidence of the condition.

Deputy sheriffs retiring under this presumption receive a pension equal to 75% of final average salary, compared to the current ordinary disability retirement benefit of approximately one-third of salary.

The presumption applies only to paid employees drawn from competitive civil service lists in the sheriff's department and does not apply for workers' compensation or labor law purposes.

Estimated to increase present value of future employer contributions by approximately $426,700 per disability retirement occurrence and $349,000 per death occurrence related to heart disease.

Takes effect immediately upon enactment.
