Requires all smoke shops in New York to obtain and publicly display a premises license from the Department of Taxation and Finance, effective January 1, 2025, with annual renewal required.

Defines "smoke shops" as businesses exclusively retailing smoking products and paraphernalia (including pipes, water pipes, vape pens, rolling papers, etc.) but excludes premises licensed to sell cigarettes or tobacco products.

Establishes location restrictions including: premises must be on commercial thoroughfares, street-level entrances only, and at least 500 feet from schools, daycare centers, hospitals, nursing homes, substance treatment facilities, and places of worship.

Limits operating hours to 9 a.m. to 10 p.m. and prohibits interior screens or partitions that obstruct views, with no window coverings permitted.

Bars individuals convicted of controlled substance or cannabis offenses from obtaining or maintaining a license, with mandatory revocation upon conviction.
