Manufacturers must submit written notification to the department by January 1, 2026 for products containing intentionally added PFAS, including product description, purpose of use, amount of each PFAS chemical, and manufacturer contact information.

Starting January 1, 2027, the sale of carpet or rugs, cookware, cosmetic products, fabric treatments, and personal care products containing intentionally added PFAS is prohibited unless deemed a currently unavoidable use by the department.

Starting January 1, 2032, all products containing intentionally added PFAS are prohibited from sale unless the department determines the use is currently unavoidable.

Violations are subject to civil penalties of up to $10,000 for the first violation and up to $25,000 for subsequent violations.

The department may identify additional product categories for prohibition if they are likely to contaminate land or water resources and pose a threat to human health or safety.
