Consumers have the right to decline replacement of existing analog utility meters with digital meters and to request replacement of installed digital meters with analog meters, with no fees, penalties, or service charges.

Utility corporations must provide written notice at least 90 days before installing a digital meter, allowing consumers to decline installation.

Utilities must comply with consumer requests to remove digital meters within 10 days if the consumer reports electromagnetic sensitivity, or within 30 days in all other cases.

For multi-unit buildings, utilities cannot install or upgrade digital meters if 50 percent or more of consumers decline permission.

Utility corporations must maintain records for at least three years of all consumer responses regarding digital meter installation or removal requests.
