Defines "children's character" to include costumes depicting legendary figures (Santa Claus, Easter bunny), mythical characters, and similar characters in positions with substantial child contact.

Defines "substantial contact with children" as allowing children to sit on the person's lap, taking photos with children, or any physical contact while in costume.

Requires employers, organizations, and government entities to conduct background checks against multiple registries including the New York State sex offender registry, statewide child abuse registry, and federal databases before hiring for these positions.

Establishes penalties of a Class A misdemeanor for first violation by a sex offender and a Class D felony for subsequent violations; employers knowingly hiring violators face a Class A misdemeanor charge.
