Department of Economic Development must commission a state-wide disparity study by January 1, 2026, conducted by an independent entity selected through request for proposal, to determine if disparities exist between qualified minority-owned and women-owned businesses ready to perform state contracts and those actually engaged.

Study shall examine whether state policies affecting minority-owned business enterprises and women-owned business enterprises require changes, with results posted on the department's website upon completion.

Within one year of study completion, the department must establish goals for equitable participation of minority-owned and women-owned businesses in state contracts based on any revealed disparities.

Department shall create certification procedures for minority-owned and women-owned businesses, maintain a current certified list, establish procedures to ensure equitable participation opportunities, and collect statistical data on actual participation in state contracting.

State contracting agencies must assess diversity practices of bidders and promote achievement of departmental goals where practicable, feasible, and appropriate; minority-owned businesses owned by women may be certified under either category but participation cannot be counted toward both goals simultaneously.
