SUNY trustees are authorized to lease approximately 25.522 acres of SUNY Albany campus land to Fuller Road Management Corporation (a subsidiary of NY CREATES) for the Albany NanoTech Complex without public bidding.

The lease or contract must be approved by the director of the division of the budget, the attorney general, and the state comptroller, and cannot exceed 40 years; all improvements revert to SUNY upon expiration or if the property ceases to be used for the Albany NanoTech Complex.

All construction work on the property is deemed public work subject to prevailing wage requirements and article 8 of the labor law, and contractors must use a project labor agreement.

SUNY cannot contract out instruction, pedagogical functions, administrative services, or work currently performed by state employees; no current state workers may be displaced or have their hours, wages, or benefits reduced.

The lease must include indemnification provisions protecting the lessor against all claims and liability, and construction contracts must be awarded through a competitive process; the lease must be executed within 5 years of the act's effective date.
