Safety net hospitals must submit an annual plan to the Department of Health outlining proposed policies and actions to generate or increase revenue.

Hospitals must submit follow-up reports annually documenting progress toward established revenue goals.

Proposed revenue-generating policies may include attracting privately insured patients, retaining patients transitioning from Medicaid to private insurance, offering profitable procedures, enrolling eligible patients in Medicaid, collecting patient payments, and developing underutilized hospital land.

Safety net hospitals are defined as public hospitals, critical access hospitals, sole community hospitals, or hospitals where at least 35% of outpatient or 30% of inpatient volume consists of Medicaid, uninsured, and dual eligible individuals, or that serve at least 30% of such members in a county or multi-county area.

The act takes effect 90 days after becoming law.
