Amends Penal Law Section 250.50 to expand the definition of unlawful surveillance in the first degree to include three scenarios: prior conviction within ten years, surveillance of a person with an active order of protection against the offender, or surveillance intended to benefit a person with an active order of protection against the surveilled person.

Changes gender-specific language ("he or she") to neutral terminology ("such person").

Maintains unlawful surveillance in the first degree as a class D felony.

Takes effect ninety days after becoming law.
