Amends Elder Law Section 241 to allow the Commissioner of Health to adopt policies excluding certain non-recurring income items from eligibility calculations for the Program for Elderly Pharmaceutical Insurance Coverage.

Specifically authorizes exclusion of non-recurring items including a retiree's previous year's wages and non-recurring distributions from individual retirement accounts that would artificially inflate available funds for current needs.

Maintains existing definition of "income" as "household gross income" from the real property tax circuit breaker credit program but adds new discretionary exclusions for non-recurring items.

Takes effect immediately upon enactment.
