Establishes an extended producer responsibility (EPR) program for packaging in New York requiring producers to register, submit plans for approval, and fund collection, processing, and recycling of packaging materials sold in the state.

Requires producers to reduce non-reusable packaging by 10% within 2 years, escalating to 50% reduction within 10 years of plan implementation, and achieve 50-90% recycling rates or post-consumer recycled content by specified timelines.

Implements eco-modulated fee structure where producers pay fees based on packaging material type and weight, with lower fees for recyclable and reusable packaging and higher fees for non-recyclable materials.

Prohibits specific toxic substances in packaging including ortho-phthalates, PFAS, bisphenols, and heavy metals effective December 31, 2025, with additional toxic substances designated every three years.

Creates the Packaging Responsibility Fund to collect penalties and fund independent audits of recyclable materials, waste disposal, and litter; requires producers to provide convenient collection access at no cost to consumers and maintain existing municipal curbside recycling programs.
