Repeals and replaces subdivision 4 of section 856 of the general municipal law to prohibit agency members from serving as elected officials of the municipality or any county, city, town, or village within the county where the agency is located.

Requires the governing body or appointing authority to appoint new agency members when a current member becomes ineligible due to being elected to public office.

Exempts industrial development agencies where elected officials are required to serve under title two of the general municipal law.

Exempts industrial development agencies whose boards are entirely composed of elected officials from the municipality that chartered them.

Takes effect immediately upon enactment.
