Prohibits tampering with motor vehicle emission control devices, selling or distributing aftermarket defeat devices, and possessing or installing aftermarket defeat devices.

Establishes civil penalties of $1,000-$5,000 for first violations and $2,000-$10,000 for subsequent violations under environmental conservation law.

Requires inspection stations to visually inspect vehicles for aftermarket defeat devices within 180 days of the law's effective date and owners must remove devices within 10 business days of detection.

Establishes Vehicle and Traffic Law violations with fines of $750 for first offenses (reducible to $300 if emission controls are restored) and $750 for subsequent offenses that cannot be waived.

Authorizes the Department of Environmental Conservation, Attorney General, and local governments to enforce these provisions, with collected penalties deposited to the environmental protection fund.
