Prohibits landlords from removing tenants from residential units based on the tenant's certified medical use of medical marihuana as defined in Public Health Law Section 3360.

Establishes that it is a defense to eviction proceedings if a landlord seeks possession because of a tenant's certified medical marihuana use, and the landlord would not seek eviction but for such use.

Allows landlords to rebut the defense by demonstrating they seek to recover possession based on other lawful grounds unrelated to medical marihuana use.

Preserves landlords' legal rights to recover possession on grounds not based on or derived from certified medical marihuana use.

Takes effect immediately upon enactment.
