Commissioner of the Division of Homeland Security and Emergency Services shall conduct a review and analysis of security measures at rail yard facilities to protect critical infrastructure, with access to all relevant audits and reports while owners and operators retain custody and control.

Commissioner must identify all rail yard facilities in the state, identify high-risk facilities that store or transport hazardous substances, and require vulnerability assessments of security measures to prevent unauthorized releases.

Commissioner shall issue a preliminary report by June 1, 2025, and comprehensive reports by December 31, 2025, then every five years thereafter to the governor, legislature, and transportation commissioner assessing security effectiveness and making recommendations.

All report recipients must develop and maintain binding confidentiality protocols to protect sensitive information that could endanger public safety, with specified exceptions for Freedom of Information Law requests.

Departments of Transportation and Environmental Conservation have discretion to require implementation of the commissioner's recommendations by rail yard facility owners and operators.
