Telehealth services shall be reimbursed at the same rates and to the same extent as equivalent in-person services under Medicaid (Social Services Law Section 367-u).

Telehealth providers are not required to be reimbursed for facility fees or clinic-related costs when neither the originating nor distant site occurs within a facility or clinic setting.

Reimbursement for additional telehealth modalities, provider categories, originating sites, and audio-only telephone communication is contingent upon federal financial participation.

Mental health and developmental disability services provided via telehealth (under Mental Hygiene Law Articles 16, 31, and 32) shall be reimbursed at applicable in-person rates, unless a specific service is deemed inappropriate by the relevant commissioner.

The act takes effect sixty days after becoming law.
