Amends Penal Law Section 130.05 to add a new paragraph establishing that persons under supervision of a local probation department are incapable of consent when engaging in sexual conduct with probation department employees.

Defines "employee" as a probation department or agency worker who supervises or has supervised the victim, provided the victim remains under probation supervision at the time of the offense.

Applies to persons under supervision of local probation departments pursuant to Correction Law Section 272 or similar local departments or agencies.

Takes effect on November 1st following the date the bill becomes law.
