Expands the definition of aggravated cruelty to animals to include committing a simple animal cruelty offense (section 353) when previously convicted of such an offense within the past 10 years.

Changes sentencing for aggravated cruelty from a definite sentence not exceeding two years to a class E felony for first offenses.

Escalates penalties to a class D felony for defendants convicted of the basic aggravated cruelty offense who have a prior conviction for simple animal cruelty.

Escalates penalties to a class C felony for defendants convicted of aggravated cruelty who have a prior conviction for aggravated cruelty.

Takes effect immediately upon enactment.
