Prohibits any person from selling or offering for sale used oil, except to oil rerefining facilities, and prohibits used oil collectors from transferring used oil except to rerefining facilities or commissioner-permitted disposal facilities

Establishes civil penalties of up to $1,000 for each violation of the used oil sale prohibition, plus additional penalties

Creates new criminal liability making knowing engagement in the sale of used oil a misdemeanor punishable by a fine of $500-$18,000 and/or up to one year imprisonment for a first conviction, and up to $26,000 fine and/or imprisonment for subsequent convictions

Authorizes courts and the commissioner to consider economic impact, compliance history, good faith efforts, environmental risk, and other factors when determining penalties and sentences

Takes effect May 1st following the date the bill becomes law, with authority granted to adopt necessary implementing regulations before that effective date
