Department of Corrections and NYC Health and Hospitals Corporation must jointly develop and implement a health care worker safety policy to protect workers from assault and violent incidents when treating incarcerated individuals.

Requires yearly training for all uniformed Department staff and special officers on minimum standards for securing incarcerated individuals during health care provision.

Mandates protocols requiring Department staff and special officers to inform health care workers about incarcerated individuals with histories of violent or aggressive behavior before admission to hospitals or medical facilities.

Department and correctional health services must publish joint reports every six months on policy compliance and submit annual reports to the legislature that include analysis of whether enhanced criminal penalties for assaults on health care workers should be considered.

Health care workers may sue the Department and/or Health and Hospitals Corporation for damages resulting from failure to enforce or comply with the established safety standards.
