Prohibits health insurers from requiring prior authorization for anti-retroviral medication used to treat and prevent HIV infection, effective 180 days after enactment.

Applies the restriction to health care plans providing prescription drug coverage under Public Health Law Section 4406-c.

Applies the restriction to insurers providing prescription drug coverage under Insurance Law Section 3217-b.

Applies the restriction to health maintenance organizations (HMOs) providing prescription drug coverage under Insurance Law Section 4325.

Permits insurers and plans to deny claims for anti-retroviral medications only if services are subsequently determined not medically necessary.
