Railroad corporations operating freight trains in New York must inform the Division of Homeland Security and Emergency Services, Department of Environmental Conservation, and Department of Transportation about hazardous material shipments prior to traveling on state tracks.

Information provided to state agencies must include the same details required to be provided to local municipalities under Public Law 114-94 (the federal Fixing America's Surface Transportation Act).

Railroad corporations must promptly update hazardous waste manifests for trains transporting hazardous materials.

Information provided under this law is confidential and exempt from disclosure under the Public Officers Law and all other disclosure provisions.

The act takes effect 30 days after becoming law, but automatically repeals if federal agencies determine it would make New York ineligible for federal funds or if courts find it conflicts with federal law or regulations.
