NYSERDA is authorized to issue a solicitation for up to 200 megawatts of offshore wind renewable energy certificates (ORECs) generated from Lake Erie within six months of the act's effective date.

The Lake Erie project must follow the same structure as Atlantic Ocean offshore wind procurements (ORECRFP22-1), with selected developers required to enter into project labor agreements and sell ORECs to NYSERDA for purchase by New York's electric ratepayers statewide.

All project components and parts must be produced or made in whole or substantial part in the United States, territories, or possessions, with limited waiver authority granted to NYSERDA's president based on public interest, cost, availability, or quality concerns.

Lake Erie offshore wind projects are designated as public work subject to New York labor law articles 8 and 9, requiring project labor agreements and apprenticeship agreements for all contractors and subcontractors.

The Public Service Commission shall issue orders requiring load serving entities to purchase Lake Erie-produced ORECs from NYSERDA and provide regulatory support for the pilot solicitation.
