Electronic cigarette manufacturers that import, sell, or offer e-cigarettes for sale in New York must submit a collection and recycling plan to the commissioner within 90 days of the law's effective date.

Vapor product dealers registered under tax law article 28-C must accept returns of used electronic cigarettes for recycling, and manufacturers must accept returns from these dealers.

Manufacturers must submit annual reports to the department detailing the number or weight of e-cigarettes received and recycled in the state, associated costs, and other required information.

Manufacturers must undertake efforts to educate consumers about proper e-cigarette recycling methods.

The commissioner has 90 days to approve or reject submitted plans; rejected plans must be resubmitted within 60 days with a 30-day review period for reconsideration.
