Creates new felony offense of "aggravated reckless endangerment" (Penal Law § 120.26), classified as a class C felony, for knowingly possessing fentanyl or fentanyl derivatives and recklessly exposing first responders or correction officers to such substances in a manner likely to cause illness or injury.

Adds aggravated reckless endangerment as a qualified offense under Criminal Procedure Law § 510.10 (securing orders), § 530.20 (bail and release conditions), and § 530.40 (recognizance and bail conditions), requiring courts to consider this charge when determining pre-trial release conditions.

Takes effect immediately upon enactment.
