Prohibits manufacture, sale, distribution, or possession of five food additives and color additives starting January 1, 2025: brominated vegetable oil, potassium bromate, propylparaben, red dye 3, and titanium dioxide.

Requires the Department of Agriculture Commissioner to update the exemption list within 30 days to declare these substances unsafe for human consumption in New York, effective January 1, 2025.

Prevents federal FDA recognition of these substances as safe from being used as a legal defense in enforcement actions by the Commissioner.

Creates a private right of action allowing any person to sue for violations in any court of competent jurisdiction, including small claims court, and permits courts to issue injunctions to prevent violations.

Takes effect immediately upon enactment.
