Creates new Penal Law § 240.33 establishing the crime of "harassment of an employee by an incarcerated individual" as a class B misdemeanor.

Applies to incarcerated individuals, detainees, juveniles in secure facilities, and respondents who intentionally harass, annoy, threaten or alarm facility employees, parole board staff, mental health office employees, probation staff, or police officers.

Covers three specific prohibited acts: displaying or touching intimate parts in view of an employee; intentionally causing an employee to view such conduct; or threatening to cause contact with blood, urine, seminal fluid, or feces.

Amends Correction Law § 851 to make persons convicted of harassment of an employee by an incarcerated individual ineligible to participate in work release programs.

Takes effect 30 days after enactment; the Correction Law amendments expire with the expiration of that statute.
