Establishes a rebuttable presumption that lung disease disabilities or deaths of deputy sheriffs in cities with populations of one million or more are job-related if the employee passed a physical examination upon hire showing no lung disease.

Applies to paid deputy sheriffs drawn from competitive civil service lists and to retired members who retired within five or fewer years and previously passed entry physical examinations.

Provides disability retirement benefits equal to three-fourths of final average salary for affected deputy sheriffs, replacing ordinary disability benefits of one-third salary.

Allows retirees already retired for five years or less who would qualify under this law to have their pensions recalculated and increased retroactively to the date lung disease became disabling.

Takes effect immediately upon enactment, with projected employer contribution increases ranging from $55,000 to $1.3 million annually for New York City over the first 25 years depending on incident frequency.
