Creates a rebuttable presumption that any crime occurring on, in, or upon a house of worship constitutes a hate crime under Penal Law Section 485.05

Defines "house of worship" as any structure or site used primarily as a place of worship on a permanent basis by a recognized and established religious sect or denomination

Excludes religious sites used primarily as schools, colleges, hospitals, or other similar structures not devoted to worship from the definition of house of worship

Amends existing gender identity or expression definitions in Penal Law Section 485.05 by changing period to semicolon for consistency with new provisions

Takes effect immediately upon enactment
