By July 1, 2027, all school districts must purchase or lease only zero-emission school buses and require contractors providing transportation services to do the same.

Zero-emission school bus components and parts must be produced in whole or substantial part in the United States, its territories, or possessions, with final assembly occurring in the United States.

By July 1, 2035, all school districts must operate and maintain only zero-emission school buses and require transportation contractors to exclusively operate zero-emission buses.

The commissioner may waive domestic manufacturing requirements if they determine requirements are not in the public interest, would cause unreasonable costs, or if sufficient quantities of satisfactory quality components cannot be sourced domestically.

Annual waiver determinations by December 31 must be publicly posted with detailed findings; if no waiver is warranted for three consecutive years, the commissioner is no longer required to provide annual determinations.
