Mandates mental health clinics licensed under the mental hygiene law to similarly establish electronic medical record access procedures for utilization review agents, developed in consultation with the health commissioner

Amends both public health law and insurance law to specify that medical records requested by utilization review agents must be made available electronically by health care providers

Updates confidentiality requirements to explicitly include electronic medical records alongside traditional medical records in state and federal privacy protections

Preserves the ability of health care plans to enter into separate agreements with providers for electronic medical record transmission
