Allows unregistered nonresident pharmacies, manufacturers, wholesalers, and outsourcing facilities to deliver prescription drugs to registered New York establishments during specific patient needs or declared public health emergencies without state registration

Requires the out-of-state establishment to be properly licensed in its home state, with the receiving New York pharmacy maintaining license verification documentation for six years

Drugs transferred must be FDA-registered manufacturer products (not compounded), delivered in original packaging with national drug code, lot number, and expiration date; expired drugs are prohibited

Limits sale/transfer price to no more than 100% of the Wholesale Acquisition Cost (WAC) and prohibits transfers of controlled substances

Pharmacies receiving illegitimate, recalled, or counterfeit products must immediately notify the state board of pharmacy and FDA; unregistered establishments become subject to New York jurisdiction for any violations

Takes effect 90 days after becoming law
