Amends the Emergency Tenant Protection Act of 1974 regarding how legal regulated base date rent is calculated for rent overcharge complaints

Requires that when an overcharge is found, the legal regulated base date rent at the four-year lookback must be determined using either the survey sampling method or the default method if fraud is present

Applies to housing accommodations in cities with populations under one million, as well as towns and villages where a housing emergency has been declared

Maintains existing provisions requiring landlords found to have collected overcharges to pay penalties of three times the overcharge amount, or the overcharge plus interest if the violation was not willful or negligent
